InclusiGear, LLC / Adaptive Avenue, LLC ("we," "us," or "our") operates the InclusiCare web and mobile applications (the "Service"). This Privacy Policy informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data.
We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.
1. Information We Collect
We collect several different types of information for various purposes to provide and improve our Service to you.
Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name

- Cookies and Usage Data
Protected Health Information (PHI)
InclusiCare is designed to store sensitive information about children and dependents. This may include health-related data, behavioral logs, medical history, and other information that may be considered Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). This includes:
- Child profiles (name, date of birth, diagnoses, medications, allergies)
- Daily tracking logs (sleep quality and duration, energy levels, mood and emotions, sensory sensitivity)
- Nutrition and eating behavior records (food preferences, aversions, hydration)
- Stress and behavioral monitoring events (triggers, intensity, duration, recovery)
- Care notes and uploaded documents (IEPs, evaluations, medical reports)
- Conversations with our AI assistant (CARLA)
- Emergency contact and medical provider information
2. Health Data Categories
InclusiCare collects and processes health-related data across the following categories. All health data is entered voluntarily by the user (parent, guardian, or authorized caregiver) and is used solely to provide caregiving support features within the app.
Sleep Management
We collect sleep quality ratings (1–10 scale) and sleep duration (hours per night) through daily tracking entries. This data is used to identify sleep patterns, calculate rolling averages, and detect anomalies that may affect the individual's well-being. Sleep trend analysis (improving, stable, or declining) is computed to help caregivers understand changes over time.
Stress Management, Relaxation, and Mental Acuity
We collect mood and emotion data (user-selected from predefined and custom emotion labels), energy levels (1–10 scale), sensory sensitivity levels, and stress-related event logs. Stress events include details such as triggers (antecedents), behavioral responses, intensity ratings, duration, and recovery time. Environmental context (noise level, crowding, lighting, routine disruptions) may also be recorded. This data is used to identify stress patterns, provide de-escalation technique recommendations, and help caregivers anticipate and manage stressful situations. Calming strategies, regulation techniques, and co-regulation approaches are tracked for effectiveness.
Nutrition and Weight Management
We collect information about eating behaviors, food preferences, food aversions, texture sensitivities, safe foods, and hydration events. Eating and hydration events are logged with timestamps, context, and caregiver observations. This data is used to help caregivers track nutritional patterns and identify sensory-related food challenges common in individuals with sensory processing differences. We do not track weight or caloric intake.
Mental and Behavioural Health
We collect behavioral event data including behavior descriptions, antecedents (triggers), consequences (outcomes), intensity ratings (1–5 scale), duration, and recovery trajectories. Events are categorized by type (behavior, stress, sensory) and include temporal data (time of day, day of week, school day status). Communication mode during events, transition context, and intervention effectiveness are also tracked. The app stores diagnoses, challenges, support needs, warning signs, and learning/communication/social preferences. This data powers pattern detection to help caregivers understand behavioral trends and the effectiveness of different support strategies.
Healthcare Services and Management
We collect and store medications, allergies, medical conditions, healthcare provider contact information (doctor name and phone), and emergency contacts. Users may upload healthcare documents such as Individualized Education Programs (IEPs), 504 plans, psychological evaluations, speech and occupational therapy evaluations, and medical reports. Caregiver profiles may include certifications, specializations, and professional experience. The Care Circle feature allows authorized sharing of this information among designated caregivers, educators, and healthcare providers.
Medical Reference and Education
We store diagnostic information (user-entered diagnoses), assessment results, and condition-specific profiles. Our AI assistant (CARLA) provides educational guidance and caregiving strategies informed by the individual's profile, but does not provide medical diagnoses or treatment recommendations. Uploaded documents such as evaluations and assessments are stored securely and can be shared within the Care Circle for reference. De-escalation techniques are provided as educational resources based on established sensory and behavioral support practices.
Usage Data
We may also collect information on how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.
3. How We Use Your Data
InclusiGear uses the collected data for various purposes:
- To provide and maintain the Service, including core features like the Care Circle, daily tracking, and AI-powered caregiving insights.
- To compute health and behavioral trends, pattern analysis, and anomaly detection to support proactive caregiving.
- To provide personalized de-escalation techniques and support strategies based on the individual's profile and history.
- To notify you about changes to our Service.
- To allow you to participate in interactive features of our Service when you choose to do so.
- To provide customer care and support.
- To provide analysis or valuable information so that we can improve the Service.
- To monitor the usage of the Service.
- To detect, prevent, and address technical issues.
Important: We do not use your health data to serve advertisements. We do not share your health data with advertisers, data brokers, or any third parties for marketing purposes. Health data is used exclusively to power the caregiving features of the Service.
4. HIPAA Compliance and Data Security
The security of your data is our highest priority. We implement administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic PHI that we create, receive, maintain, or transmit.
- Encryption: All data is encrypted in transit (using TLS/SSL) and at rest (using AES-256 encryption) on our servers and databases.
- Access Controls: Access to your data is strictly controlled. Only you and the individuals you explicitly invite to your "Care Circle" can view the child profiles you manage. Our staff only accesses your data when necessary for support or maintenance, and under strict confidentiality agreements.
- AI Processing: When you use our AI features (CARLA), your data is processed securely. We use enterprise-grade AI providers that do not use your data to train their public models. The names of our service providers are available upon request.
- Data Minimization: We only collect health data that you voluntarily provide through the app's features. We do not access device health sensors (such as HealthKit or Google Fit) or collect biometric data.
While we strive to use commercially acceptable means to protect your Personal Data and PHI, remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. We cannot guarantee its absolute security.
5. Sharing and Disclosure of Data
We do not sell, trade, or rent your Personal Data or PHI to third parties. We may disclose your information in the following situations:
- Service Providers (Business Associates): We may employ third-party companies and individuals to facilitate our Service, provide the Service on our behalf, perform Service-related services, or assist us in analyzing how our Service is used. These third parties have access to your data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. They are bound by Business Associate Agreements (BAAs) where applicable.
- Legal Requirements: InclusiGear may disclose your Personal Data in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend the rights or property of InclusiGear, prevent or investigate possible wrongdoing in connection with the Service, protect the personal safety of users of the Service or the public, or protect against legal liability.
- Care Circle: By inviting members to your Care Circle, you are explicitly authorizing the sharing of the child's profile and related data with those individuals.
6. Your Rights Regarding Your Data
You have the right to:
- Access: Request a copy of the Personal Data and PHI we hold about you.
- Amend: Request that we correct any inaccurate or incomplete data. You can update most of your information directly within the app.
- Delete: Request the deletion of your account and associated data. Upon deletion, your data will be permanently removed from our active databases, though residual copies may remain in secure backups for a limited time as required by law or our disaster recovery policies.
- Export: Request an export of your data in a structured, commonly used, and machine-readable format.
- Restrict Processing: Request that we limit processing of your health data to specific purposes.

7. Data Retention
We will retain your Personal Data and PHI only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
8. Children's Privacy (COPPA Compliance)
Our Service is designed to be used by parents, legal guardians, and authorized caregivers to manage the care of children, including children under 13. We do not knowingly collect personally identifiable information directly from children. All data entry is performed by the parent, guardian, or authorized caregiver who has created the account and manages the child's profile.
The child's health and behavioral data is entered by the authorized adult caregiver, not by the child. If you are a parent or guardian and you become aware that your child has independently provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes.
